XNA Game Studio Express is intended for students, hobbyist, and independent (and by extension, homebrew) game developers.[1] It is available as a free download. There was another package earlier on.. which had an agreement that anything made in the Express and Basic packages, was owned by Microsoft. I'll try and find that.. but the above basically says you have to pay to have the games work on an Xbox..
