    More idiocy and litigation...

    Some twit is trying to sue Waverley (?) council out here in Oz, 'cause he is paralysed after diving into a sandbank at the beach...
    No doubt he claims they should have put up magical signs that let you know when the tide is out and that diving into water without checking the depth is a bad idea...
    He'll prolly bloody win too...

    Nope he wont win!

    Some seppo tried to sue the Cottosloe council over here for exactly the same reasons.
    He lost the judge "throwing it out of court!"

    Coz i do believe the judge would take into consideration the case that went on over here!

    They're all getting worried these days I reckon. Apparently one of the airlines is showing 'tourist saftey' vids on flights into Oz now - stuff like 'don't kiss crocodiles' - you know, stuff you wouldn't have thought of yourself unless you were a super genius...

    In the SMH yesterday they pondered that the power of lawyers has increased becos politicians now almost all come from the ranks of law. In the old days they were horse and carriage drivers and stuff like that.

    I received this in an e-mail a few years ago. It was said this was written by some senator or congressman. I really doubt that, but it's good all the same. It's called the Bill of No Rights:
    We, the sensible people of the United States, in an attempt to help everyone get along, restore some semblance of justice, avoid any more riots, keep our nation safe, promote positive behavior and secure the blessings of debt-free liberty to ourselves and our great-great-great grandchildren, hereby try one more time to ordain and establish some common sense guidelines for the terminally whiny, guilt-ridden, delusional and other liberal, bedwetters. We hold these truths to be self-evident: that a whole lot of people were confused by the Bill of Rights and are so dim that they require a Bill of No Rights.

    Another one in a paper today - a bloke breaks into a hotel premises, the manager hit him, and he is suing the manager for $750,000. Apparently his mother is suing too, although that's just a sub-heading - I didn't read the story. The guy suing looks fine to me though...

    But by far the most ridiculous one - on the radio this morning, apparently a guy who Nicole Kidman has named as a stalker is taking a suit against her and some film companies to the order of $US 373million - because he claims the stalker thing is defamation, and it will hurt his chances when he runs for US president in 2004... LOL

    The US's laws are more lax towards that sort of thing, in Canada you can't sue for stupid stuff like the hitting thing or hurting yourself on govnmt property or just being a ****ing idiot

    Well, he won...

    What a ****ing joke. Apparently the claim was based on the placement of the flags. He was between them, dived into a sandbar, and sued the council... Christ, I've been going to the beach since I was a little pecker, and I've seen sandbars in the flags hundreds of times - nobody dived into them though...

    How bloody ridiculous can this get? If the council didn't put flags up, people would die, that's unarguable. There are too many stupid people and tourists who can't swim. So they do the good thing, and have lifeguards, and designated safe-zones, and some dumb ***** dives into a sandbar, and now the whole concept of lifesaving and the flags is questioned. I ****ing hate this situation.

    Now councils will be faced with massive insurance premiums against bull**** like this, and soon enough, there will be no lifeguards. Especially in smaller, poorer areas. Most of the lifeguards are volunteers anyway - why the **** were they responsible for this idiots actions? Christ, if only someone would stop this, I might actually want to vote next time an election rolls around...

    What's screwed up beyond what you've already talked about, rj, is that when they put up signs to help people, it gets used against them.

    I.e. "You knew there was a problem because you put up signs, right?" What a bunch of bull****.

    So if they take down the signs, what happens? There is no common sense in law.

    They had a bloke ring up the radio this morning, saying he'd done a similar thing as a young bloke - he'd split 3 of the vertebrae in his neck, and was unable to walk for awhile. He said "I'm not gonna go suing someone else cause I did something stupid."
    Something needs to be done, it really does.
