why won't the forum let me use an animated .gif as my avatar?

Its because animated avatars are a benefit of being in the PowerPosters group. To get into that group you need 2048+ posts.

i've seen users with animated avatars with fewer posts. or am i mistaken?

If there is then its because they have had them before the level was created. If they were to change their avatars now they will loose that ability to have animated avatars.

another question about the avatars.
if my avatar is larger than 60*60 pixels but the file size is smaller than the max file size, could i use it?

No, it needs to be in accordance with both settings. 64x64 and less then 19.5k
