is there a way i can avoid that by controling the code or any other means (no placing list on its way ..!! )

If your really good with javascript then it would probably be possible, however changing those functions written by other people always seem to break it. Can you just move the select box somewhere else?

the selectbox will allways be ontop..
maby try to add the menuscript to a ilayer or something like it...
