Domain Names
What is the requirements (if any) for having a .org domain name? I mean is it something that is just implied as a non-profit company or just like any of the other extensions? Would it hurt to have a .org but be a commercial site?

You have to prove that you are an organization, and not for profit.

It depends on your registrar. It definitely implies that you are a non-profit organisation, but in reality is more or less meaningless.

I have a friend that has a .org and hes definately a profit organization lol.
So then it would be a bad business decision to get a .org if the .com is unavailable.

I wouldnt .. get a .net or .com .. or even a .bs (bahamas=.bs)

I think it would be a bad for his business.
Some non-computer savvy users often omit the gTLD part. So, the browser most of the time opens the .com site or the search page.
And in general people expect a commercial site to be .com, they may find it hard to remember the .org part. ( http://www.whatismyip.org/ is faster and easier to parse, but most developers use http://www.whatismyip.com/ )

That sounds like an unforgivable extension rory.
.com/.net are two that are definately required but also unavailable for a desired name. I'm looking for other possibilities but doesnt look good. The name in question for .com is not in use and not parked. The .net version is not in use either but has been parked. Both are owned by two different people/companies.
Are the odds good for some kind of litagation since they havent done anything with the names? Force or show domain name squatting?

LOL yeah and they charge something like $100 a month for those .bs extensions .. needless to say mostly government use them cause us regulars arent that crazy, we gone with .com/nets .. for over $1000 less ..
I imagine if the people squatting on it, if they are located in the US it will be easier, if they are outside the US it may be more difficult.

The name I am trying to get is wordspellchecker.com. I posted my code in 7.19.2005 and they got the name in 6.14.2005. Its a stupid search site so perhaps I have a leg or two to stand on? How should I go about doing it? Ask them to sell it to me or ???

Well according to the copyright.gov site, since I used the ™ char when posting it that basically solidifies a publishing date. The holders of the domain name never published their stuff in the public domain so its never been "published". This may be may strongest argument.
